The practical implication is that AI inside a CE-marked medical device or IVD inherits both MDR/IVDR conformity assessment and the AI Act's additional Article 16 to 29 obligations, layered together. Vendors must show how the dual conformity assessment is run without duplicating effort.

The FDA's Software-as-a-Medical-Device action plan and the Predetermined Change Control Plan guidance (final January 2025) define how AI/ML-based medical software can be updated post-market without a new submission for each change [7]. The practical implication for vendor selection is that any AI shipped into a US clinical workflow needs a pre-specified change protocol and a risk-based monitoring plan if the model will retrain.
